Remember, most people from countries that qualify for E2 visas, have 3 year degrees, not 4. At least at the undergraduate level.

I have heard that, but my undergrad was four years from Canada. I had a friend from Manitoba who said he only had a 3 year undergrad, but because he effed around a lot during university it took him four years to get and he claims that's how he was originally allowed to get an E2.  It'd be interesting to see the breakdown of who has a three or four year undergrad on an E2.

I remember back in 2001/2002, immigration suddenly realized that a number of countries weren't 4 year degrees and did what immi do best, and started changing rules on the spot. It took bit of negotiation from the relevant governments to assure Korea that the 3 year degrees were infact the equivalent of 4 year degrees, and just as much work, but crammed into 3 years. What a shit-show at the time. One guy that worked with me had to do an ESL certificate (online), so he could renew his E2 visa, and appease immigration.
