A new USA Supreme Court Judge on the way
« on: January 27, 2022, 09:24:27 am »
https://www.cbc.ca/news/world/us-supreme-court-breyer-retire-1.6328448

Bill Clinton's appointee in 1994, Judge Stephen Breyer (Liberal) is retiring and Biden will appoint a new Supreme Court Justice, whom he has said will be a black woman.

So, President Biden is appointing a person to the highest court in the country based primarily on race and sex, ability comes third.

Hmmmm......His VP selection didn't turn out so well. At least it won't upset the balance of 6-3 Conservatives - Liberals

I thought it was illegal for the federal government to discriminate during hiring based on race or gender?

You seem to be implying that a woman or a person of color can't have the necessary qualities to sit on the Supreme Court.

The federal government practices affirmative action when choosing who to hire.

Interestingly, the US Supreme Court will hear a case that challenges affirmative action in higher education.

"The Supreme Court announced Monday it will reconsider race-based affirmative action in college admissions, a move that could eliminate campus practices that have widely benefitted Black and Hispanic students."
https://www.cnn.com/2022/01/24/politics/supreme-court-harvard-unc-affirmative-action/index.html

The conservative majority (including three Trump appointees) could decide that race should no longer be a factor in college admissions.

No, that's what people who enact affirmative action think.

How in the heck do you get that? Biden made it a campaign pledge to nominate a black woman to the SCOTUS if he became president.
Man, you are so far off base it is ridiculous.

And where were you when Reagan promised a woman would be his nominee to the Court?

An obvious reference to Biden's priorities which were the same when he chose his running mate.

And my point still holds. You're inferring a woman of color can't be qualified for the position.

The inside story is that Biden is repaying a political favor.

"After having performed poorly in Iowa and New Hampshire, Biden needed to win South Carolina in February 2020 if he hoped to have a shot at the Democratic nomination. Clyburn, the House majority whip and former chairman of the Congressional Black Caucus, offered to endorse the faltering candidate but reportedly demanded that he make a public pledge to place a Black woman on the high court."

Nothing "inside" about what is essentially a rumor dressed up to look like news. And it's not news that the black community expected a person of color to be nominated as VP by Biden as payback for their support in making him the Democratic nominee. It was also smart politics to diversify the ticket.

As from a woman of color on the Supreme Court, "a government of the people," all the people not just some of the people.

That's not the inference.

The inference is that Biden will use the qualities of race and gender first and second and then look to ability. It says nothing about other people evaluating judges nor that black women cannot be qualified. It is simply stating that qualities other than ability will be considered first amongst the pool of qualified people.

Clarence Thomas?
I dont have a problem with him and I wont have a problem with whomever Biden picks assuming they aren't just a complete hack, i.e. Harriet Meyers.

But the libs have to be careful. You need jurists who show real acumen in writing opinions because if Breyer's replacement is more Sotomayor and less Kagan, youre going to have a THIN bench. Breyer wasn't electric either but he had his moments. You will have gone from Stevens, RBG, and Souter to Kagan and...

The right can get good stuff out of Roberts, Alito and Gorsuch. Kavanaugh and Barrett could also develop. Only Thomas is a dud.

Also, the number one qualification for SCOTUS is age, followed by adherence to party ideology. Ability is further down the list.

I call BS on it all. If Biden cared about under represented groups he’d nominate an Asian, Pacific Islander, Or Native American, to the Supreme Court.

The new rumour in circulation is that Biden will stick Kamala Harris on the SCOTUS. This would solve 2 problems.

1) Getting rid of a complete idiot as the VP

2) A black woman on the supreme court.

annnd......where are all the albino reps????????

I'm happy putting all 4 on the Supreme Court.

Nah. You're blowing smoke to cover the misogyny and racism that lurks behind the contemporary conservative movement.
